The State of the Canadian Cannabis Business Since Legalization

The legal battle for the sale of cannabis in Canada has been a long one, and the day it came into fruition was on October 17, 2018. 

In the first 24 hours after legalization, about 100,0000 orders were made on the Ontario Cannabis Store (OCS) online store. OCS also found that its website had about 1.3 million unique visitors in the first 24 hours. This was in addition to getting 12,000 online orders in the very first hour.

“The OCS has been truly amazed by the volume of sales,” Patrick Ford, the president of OCS, said. “It’s way beyond what we anticipated and we appreciate customers’ patience as this exciting new business gets off the ground.”

Two weeks after the legalization of sales, Statistics Canada found that the total sales of cannabis in stores amounted to $43 million. The popularity of cannabis in Canada was not necessarily a surprise, as prior to the legalization of sales, about $5.7 billion was spent in 2017 on the product. 

This value was based on both the recreational and medical use of cannabis. The parties involved in spending this amount were Canadians between the ages 15 to 64. “This was equivalent to around $1,200 per cannabis consumer,” Statistics Canada added.

In a recent report that was released on October 30, 2019, it was found that seniors are the leading age group when it comes to the growing use of cannabis. This is despite being the age group that uses cannabis the least compared to the other groups. 

For instance, in 2012 alone, 1 per cent of Canadian seniors reported on their usage of cannabis. This is a contrast to 2019, when over 400,000 seniors have used the product in the last three months before October 2019.

According to the information that was collected during quarters two and three, more than one-quarter of Canadian seniors used cannabis for the first time as well. It was also found that the first-time usage of cannabis is affected by age. While seniors in the 45 to 64 age group account for 25 per cent of usage, individuals aged 25 to 44 who used cannabis for the first time account for 10 per cent.  Adding to this, users aged 65 and older makes up for 27 per cent of cannabis usage.

The most common reasoning behind the use of cannabis among seniors pertains to medical needs. While 52 per cent of seniors who are 65 and older use cannabis for medical reasons, 48 per cent of the remaining seniors are evenly split in terms of using cannabis medically and non-medically at 24 per cent each. 

This is in contrast to the 15 to 24 age group, which had about 60 per cent account for using cannabis for non-medical reasons. Users in this age group who use cannabis for both medical and non-medical purposes account for 35 per cent. As for exclusive medical use of cannabis, Statistics Canada stated that, “the youngest age group was rare, making the estimate too unreliable to be published.”

When it comes to obtaining cannabis, seniors are the age group that is the most likely to get it from legal sources. According to the data, 41 per cent of users who are 65 and older noted that they obtained cannabis through legal means. This is a sharp contrast to younger consumers who, depending on their age, account for only 23 per cent to 29 per cent of obtaining cannabis from legal sources.

The interest in cannabis is not lost to Canadian investors, and some of them have looked to the U.S. for potential growth opportunities.

On November 14, 2018, an individual who requested to remain anonymous received a lifetime entry ban into the U.S. The ban was on the basis of being part of the cannabis industry itself. That was not the only case of an investor being barred for life when it comes to U.S. entry. Prior to the legal sale of cannabis in Canada, another investor was already subjected to the same consequence. 

In May 2018, Vancouver-based investor Sam Znaimer was heavily scrutinized at the Washington border. In an interview, he recalled that he spent about four and a half hours at the border station before being issued the permaban. 

The reason for this was because of U.S. federal laws. Therefore, the connection to the cannabis industry is a risky one for Canadians dealing with U.S. Customs and Border Protection.

“You might as well be doing business with Pablo Escobar, selling cocaine in the U.S.,” Len Saunders, a Canadian immigration lawyer, said. Saunders also noted that cannabis remains a “so-called Schedule 1 substance in the U.S., defined by having no medical use and a high potential for abuse.”

Before the end of 2018, another Canadian was called into question. Roderick Elliot was on his way to the same cannabis conference as the aforementioned anonymous individual when he was subjected to heavy screening. 

Elliot was not an investor, but rather the senior vice-president at the lobbying firm Global Public Affairs. His plan was to depart from Toronto to Las Vegas. In an interview with the Financial Post, Elliot recalled that, “The first border guard asked us specifically why we were going to be in Las Vegas, and when we said we would be dropping by at the Marijuana Business Conference, he said ‘I’m going to need you to come with me.’”

He also recalled that he and his colleagues were sent to a large room with 10 other conference attendees. He said that within the room, they were prohibited from using their mobile phones and talking with each other. 

Elliot noted that in hindsight, he should have thought more about his travel route from Toronto to Las Vegas, as opposed to opting for the direct route. “But I can’t lie at the border, so I had to say I was going for a cannabis conference,” he said.

The Current State of Cannabis Legalization in Canada and U.S. Federal Law

According to the U.S. Embassy and Consulates in Canada, “Although cannabis is decriminalized in several U.S. states, cannabis possession remains against federal law. U.S. Customs and Border Protection enforces federal law at the border.”

“A Canadian citizen working in or facilitating the proliferation of the legal marijuana industry in Canada, coming to the United States for reasons unrelated to the marijuana industry will generally be admissible to the United States,” the embassy stated. “However, if a traveler is found to be coming to the United States for reasons related to the marijuana industry, they may be deemed inadmissible.”

Since October 17, 2018, the legal sale of cannabis has been allowed in Canada. 

According to Statistics Canada, prior to the legalization of cannabis, a study in 2017 found that the total amount spent on marijuana totaled $5.7 billion. This monetary amount pertained to both the medical and non-medical use of cannabis, and is “equivalent to around $1,200 per cannabis consumer.”

The Prevalence of Credit Card Fraud in North America

Credit card fraud has been prevalent recently due to the use of card skimming. Earlier this year, it was discovered that a hacking group, named Mirrorthief, used a scripting technique to siphon data from 201 online campus stores. 

Across Canada and the U.S., the hackers harvested sensitive information such as addresses, phone numbers, names, and full card details of the online customers. They were able to do this through a campus retail software called PrismRBS. 

Trend Micro, which discovered the hacking group, also stated that the hackers used PrismWeb, which is a platform designed by PrismRBS for college students. 

“The attacker injected their skimming script into the shared JavaScript libraries used by online stores on the PrismWeb platform,” the Trend Micro report read. “We confirmed that their scripts were loaded by 201 campus book and merchandise online stores, which serves 176 colleges and universities in the U.S. and 21 in Canada.”

In response, PrismRBS released an official statement about the skimming incident. The statement noted that on April 26, 2019, the company became aware of an unauthorized third-party that obtained access to e-commerce websites. Once PrismRBS was aware, they issued an investigation through an IT forensic firm, as well as notified payment card companies and law enforcement. 

This card skimming case wasn’t the only one to occur in 2019. On October 7, hackers were able to get into Macy’s website and harvest sensitive information. This information include payment information, addresses, and names. 

Upon discovering the attack a week later on October 15, Macy’s shut it down. The store chain also issued an official statement about the incident. “On October 15, 2019, we were alerted to a suspicious connection between macys.com and another website,” the statement read. “Our security teams immediately began an investigation. Based on our investigation, we believe that on October 7, 2019 an unauthorized third party added unauthorized computer code to two (2) pages on macys.com.”

As for the number of customers affected by the attack, Macy’s told Bleeping Computer that victims amounted to a “small number.” Macy’s added that it had since implemented “additional security measures” as a means of skimming prevention.

As the popularity of e-commerce continues to increase, the use of card skimming and credit card fraud are on the rise as well. Campus stores and Macy’s are not the first to experience this, and they would not be the last. Previously, major brands such as Newegg, Ticketmaster, and British Airways were victims of fraudulent activity.

The Current State of Payment Gateways

For merchants, a payment gateway is what helps with transactions between a payment portal and an acquirer such as a bank. Some examples of payment gateways include PayPal, Authorize.Net, and Skrill.

Such service facilitators are integral to the success of a business. This is because factors such as slow transactions, the number of steps involved, and the amount of authorization measures can put a customer off of making a purchase.

Recently, The Strawhecker Group (TSG) published a report on its latest Payment Gateway Directory. The report featured information about factors such as slow or variable performance, APIs, uptime, and authorization rates. Complete with research on approximately 100 payment gateways from both regional startups and reputable international players, TSG was able to shed light on several key points.

Firstly, the market for payment gateways is quite diverse. For instance, it includes several types of entities such as payment networks, new entrants, acquirers, standalone gateways, and terminal providers. 

Payment networks, for instance, include Visa and Mastercard. Meanwhile, acquirers encompass Elavon and Worldpay. As for new entrants, they include Adyen and Stripe. A couple of terminal providers in the report are NCR and Verifone. In addition, some standalone gateways include PayTrace and eProcessing Network. 

Another key point is that 26% of the analyzed gateways pertain to restaurants. Comparatively, this is very close to that of the healthcare industry at 25%. As for B2B merchants, they account for 16% of the top target markets, and 15% are relevant to nonprofits. 

Diving deeper into the report, TSG also found that gift cards are popular when it comes to the support of them. Of the gateways analyzed, 58% of them support gift cards. It should be noted, however, that the rest of the gateways have not yet implemented closed-loop gift card functionality. Closed-loop gift cards are ones that are issued to customers by a merchant. These cards can only be used at the merchant’s own store. 

When it comes to fees, 74% of the gateways analyzed charge a monthly fee, with a median fee of about $18. The lowest fee being charged is $1.20, and 26% of gateways do not charge a monthly fee.

Another significant point to take into consideration is how PayPal is not supported by 58% of the gateways in question. This is in addition to how 86% of gateways do not support PayPal Credit. 

In terms of where payment gateways serve, there is a mix of them that are regional within North America and around the world. The European market, however, is not a focus of the gateways analyzed by TSG.

Payment Strategies For Fraud Prevention

As the number of merchants using e-commerce for their businesses continues to increase, payment fraud is also on the rise. The cost of fraud through the means of online purchases can lead to a negative impact on a business’ bottom line, decrease business efficiency, as well as damage the trust between merchants and their customers. Whenever fraud occurs, it requires urgent attention and the ability to fight back and prevent it from happening again in the future. 

In a study conducted by LexisNexis, e-commerce fraud in the U.S. accounted for an average of 2.38 per cent of revenue in 2018 alone. “Successful retail fraud attempts have risen almost 30 [per cent] in our year-over-year study,” the study also found. 

It should be noted that the cost of fraud is dependant on the sector. For instance, fraud affects digital goods more than physical ones. In addition, larger businesses are more at risk for fraud compared to smaller businesses. 

One of the best ways to fight against fraud is through the use of chip technology. In 2018, Visa found that the technology reduced counterfeit fraud by 76 per cent after merchants decided to complete a chip upgrade. According to the study, the counterfeit fraud dollars for all U.S. merchants also decreased by 49 per cent. 

The technology in question is the transition into using the EMV chip payment method. Since October 2015, the adoption of this technology succeeded in decreasing counterfeit fraud as the number of merchants using chip-enabled technology increased by 219 per cent by the end of March 2019. This technology is also being used for contactless payment cards. These particular cards allow users to simply “tap” on a terminal to make payments. 

Another effective way to fight against e-commerce fraud is to apply means to prevent it in the first place. For instance, there are some red flags that merchants can be on the lookout for when managing their website and sales. Warning signs include, but are not limited to, the shipping and billing address contradicting each other, multiple orders with different cards to the same address, unprecedented large orders, as well as multiple orders of the same product. 

While these are useful warning signs of fraud, they are not failsafe. This is because these signs highlight how difficult it can be to fight fraud in the first place by virtue of not being guarantees. Every situation can be different, so while a transaction appears to be a red flag, it can nonetheless be genuine. Not accepting these genuine transactions can, in turn, negatively affect one’s business. 

Therefore, it is useful for merchants to have, for example, services like address verification and fraud scoring tools. When it comes to address verification services, they can compare billing addresses with the ones already on an issuer’s database. This type of service also adds two types of data authorization requests, namely the cardholder’s address number, as well as their ZIP code. 

As for fraud scoring tools, they can come in the form of payment processors. These processors utilize a database to determine what constitutes as viable transactions. For instance, a score that determines whether or not a transaction is fraudulent or not can be determined by an IP address, card security code, or even through biometric measurements like a fingerprint and a face scan.
